How
to book
Once you have decided to book a safari through us, you confirm
this by fax, e-mail or letter. Tou Safaris will then send
you a confirmation of your booking, invoice as well as our
banking details. Your booking is confirmed and accepted
by us once you have placed a 25% deposit for the value of
the services to be rendered by Tou Safaris. The balance
of which should be paid no later than 8 weeks prior to departure.
Tou Safaris reserves the right to cancel, without notice,
any reservation in respect of which the required 25% deposit
or the balance thereof has not been received.

Cancellation policy
Cancellation of your booking must be
done in writing. Cancellations are only effective on receipt
of written notification. Upon receipt of the written cancellation
the following charges will apply:

In some instances higher cancellation fees may be imposed
other than those stated above, should Tou Safaris decide
thereupon. Should you arrive later than booked or leave
prior to the completion of your stay, no refund can be made.

Insurance
Comprehensive travel and cancellation insurance is compulsory
on all our safaris and it is the responsibility of the client
to take out insurance from the date that they confirm their
itinerary with us. Also, please note that if the reason
for cancellation falls within the terms of any holiday insurance
policy, then any such charges will normally be refunded
to the client by the insurance company, subject to the terms
of the client's insurance.

Itinerary changes
Tou Safaris reserves the right to change
any safari due to unforeseen circumstances, such as road
conditions, weather conditions, etc. outside the control
of Tou Safaris. The company will try to provide an adequate
alternative, but will accept no liability whatsoever.

Itinerary changes requested by the client
Should the client wish to change the
itinerary after the booking has been confirmed, Tou Safaris
will try to accommodate the client, subject to availability.
This may charge up to the cancellation fees though. This
is subject to a new quotation, which will be given to the
client in writing.

Safari prices
Tou Safaris will do their utmost to
keep to the prices agreed upon. Safari prices are subject
to alteration without prior notice and should increases
be forced on Tou Safaris by increasing fuel prices, exchange
rates, new taxes etc. Tou Safaris reserves the right to
surcharge without notice, up to a maximum of 25% of the
safari rate.

Responsibility
All clients are required to sign an
indemnity. Neither Tou Safaris nor any person acting for,
through or on behalf of the company, shall be liable for
any loss or damage whatsoever arising from any causes whatsoever
and without restricting the generality thereof. The aforegoing
shall particularly not be responsible for loss or damage
arising from any errors or omissions contained in its brochure
or other literature, late or non-confirmation or acceptance
of bookings, loss or damage caused by delays, sickness,
injury or death and weather, occasioned by negligence or
not.
In
addition, Tou Safaris shall have the right at any time and
at its discretion to cancel your stay or part thereof or
make alterations in accommodation, price or other details.
The same accounts in the event of any safari being rendered
impossible, illegal or inadvisable by weather, strike, war,
government or interference or any other causes whatsoever.
The extra expenses incurred as a result thereof shall be
the responsibility of the client.
Tou
Safaris may at its discretion and without liability or cost
to itself, and at any time cancel or terminate the clients
booking. Without limiting the generality of the aforegoing,
it shall be entitled to do so in the event of the illness
or the illegal or incompatible behaviour of a client, who
shall in such circumstances not be entitled to any refund.
The
person making any booking will, by confirming such a booking,
warrant that he or she has the authority to enter into a
contract on behalf of the other persons so included to make
payment. The person making the booking shall by his or her
signature thereof assume personal liability for the total
price of all bookings made by him or her.

Delays
In the event of changes of programmes and schedules due
to any unforeseen reasons resulting in total or partial
cancellation of a booking or any additional services rendered,
Tou Safaris shall be in no way liable for cancellation fees
and costs arising from such changes and delays.

Refunds
Whilst Tou Safaris endeavours to ensure that all anticipated
accommodation is available as planned, there shall be no
claim of any nature against the Company for a refund, either
in the whole or part, if any accommodation or excursion
is unavailable or the client was unable to use that service.

Weather
Neither Tou Safaris, nor their employees, nor agents can
be held responsible for any weather conditions and no refunds
shall be paid for circumstances incurred by weather conditions.

Wild animals
Please be aware that our safaris may take you into close
contact with wild animals. Neither Tou Safaris, nor their
employees, nor agents can be held responsible for any injury
or accident on the safari.

Special diets
Clients requiring special diets are advised to warn us well
in advance of their departure.

Authority on tour
The decision of the safari guide will be final on all matters
likely to endanger the safety and wellbeing of the group.

Consent
The payment of the deposit or any other partial payment
for a booking on a safari construes consent to all provisions
of the conditions and general information contained herein.
This agreement is made subject to and shall be governed
by and construed according to Namibian law.
